Seven get rigorous imprisonment for life in murder case

BARPETA, June 18 - The court of the District and Session Judge here sentenced seven convicts to rigorous imprisonment for life after found guilty in a murder case.

Abul Hussain, son of Rafet Ali and a resident of Khandakarpara Bhella under Barpeta police station in Barpeta district, was attacked by a group at around 12 noon on October 24, 2001, with sharp weapons. While victim Abul Hussain sustained serious injuries, two others, Arfatun and Jibu Ali � who tried to prevent the attack � sustained injuries.

Abul Hussain was rushed to Gauhati Medical College and Hospital where he succumbed to injuries after 27 days.

Relatives of Abul Hussain filed an FIR following which the District and Session Judge of Barpeta commenced the judgment in 2004 acquitting the accused on the ground of technical fault in the report of the medical officer. The petitioner then approached the Gauhati High Court which also upheld the verdict of the Session Court.

Later, the petitioner moved the Supreme Court. A two-judge bench of the SC nullified the technical fault in the report of the medical officer and questioned why the statements of the eye witnesses were not given due importance and taken into consideration. The bench referred the case to the Session Court for re-examination.

On May 24 this year, the District and Session Judge heard the matter and passed its verdict on June 16. It also fined the accused Rs 10,000 each failing which they will have to undergo another six months of imprisonment.
