Punitive action against doctor in Delhi

GUWAHATI, Nov 17 � The Delhi Medical Council (DMC) has directed removal of the name of Dr Inder Singh Virdi of the Saket, New Delhi-based Max Hospital, from the �State Medical Register� of the DMC for a period of one month with effect from 30 days after the issue of the DMC directive. The DMC issued the directive on November 3.

The DMC directive came in the wake of a complaint filed by the family members of the Late Jayant Bhuyan, the then Deputy Director General of the Confederation of Indian Industries (CII). Bhuyan had died following a bypass (CABG) surgery at the Max Hospital on October 4, 2008. Dr Virdi, Chief and Senior Consultant CTVS, Max Devki Devi Heart and Vascular Institute, has been found guilty of medical negligence by the DMC.

The DMC has dismissed the argument of Dr Virdi that the death of Bhuyan occurred due to an accident stating that the �event cannot be categorized as an accident because it has not proceeded from unknown cause nor were its fatal implications unforeseeable.�

It has further stated, �In the present case, it is apparent that the standard protocol was not followed, as due care was not taken to ensure the safety of the patient. The consequence of these failures, which proved to be fatal for the patient as confirmed by post-mortem finding of hypoxic brain damage, was an act of medical negligence.�

However, the DMC has maintained that the allegations of professional misconduct against Dr Pervez Ahmed, CEO, Max Hospital, in this case, are �devoid of any merit and stand dismissed.�

Reacting to the DMC directive, Late Jayant Bhuyan�s brother Ajant Bhuyan said, �Mere suspension for one month in Delhi only is too lenient a sentence. As far as our opinion is concerned, the doctor should have been debarred from practising for the rest of his career, for, he is involved in a medical negligence which resulted in the death of our elder brother.�

Ajant Bhuyan has also regretted that the Max Hospital authorities have not taken any step against Dr Virdi for his negligence, which resulted in the death of Jayant Bhuyan.
