One sentenced to death for rape, murder of child in Bilasipara

DHUBRI, March 30 - The Court of Special Judge, Bilasipara on Friday sentenced one Gauri Shankar Nath alias Banka to death for rape and murder of a seven-year-old on April 29, 2018.

The Additional Session Judge, Bilasipara Sarmila Bhuyan, who is also the Special Judge in the Sub-Divisional Court delivered the judgment in Special (POCSO) Case No. 04 of 2018. She also imposed fine of Rs 5000 and in default of payment of fine, SI of six months u/s 302 IPC�. It may be mentioned that this is the first case in the Bilasipara Court where, such sentence has been delivered and the judgement of the case was given within 11 months from the date of the crime.

The Court found the accused Nath, guilty under u/s 376 AB/302/201 of IPC to be read with Section 6 of POCSO Act.

According to the police, the seven-year-old child, was on a visit to Laupara area under Sapatgram PS from Guwahati, for an NRC hearing and to attend a marriage ceremony last year. While the guardian of the victim was in the marriage party, the accused invited the victim to show her the village. The accused who was known to the victim, went with him. Later, the accused raped the seven year old child, choked her to death and threw the body in a pond.

Meanwhile, the Special Judge has also ordered the DLSA Dhubri to make necessary enquiry to provide the compensation to the next kin of the deceased under the Victim Compensation Scheme as envisaged u/s 357 A CrPC �as the State failed to protect the life of the deceased�.
