Life sentence awarded to murder convict

ITANAGAR, Aug 18 - Court of Sessions Judge, West Sessions Division, Yupia has awarded life imprisonment to a convict in the murder case of Subash Jeram at Doimukh way back in 2006.

The judgment was pronounced by Jaweplu Chai, Sessions Judge, Yupia recently.

As per the verdict, the convict Biri Taling was sentenced to undergo imprisonment for life and to pay a fine of Rs 5,000 and, in default of payment of fine to undergo further RI (rigorous imprisonment) for six months for the offence punishable under section 302 of Indian Penal Code (IPC).

Taling was also sentenced to undergo SI (simple imprisonment) of three years and to pay a fine of Rs 1,000, in default of which he has to undergo further SI for one month for the offence punishable under IPC section 201 (causing the evidence of the commission of offence to disappear).

�Both the sentences shall run concurrently,� ordered the Judge, adding �� the sentence of imprisonment to the convict is just, fair and adequate in the interest of justice�.

Subash Jeram had succumbed to his injuries at General Hospital, Naharlagun after being assaulted by Biri Taling with a dao at Dikrong bridge, Doimukh on September 17, 2006. �The incident happened in a moment of anger�.

Defence counsel T Pertin prayed to the court to be lenient on him (accused) and give him an opportunity for becoming a better person.

However, the public prosecutor R Sonar submitted that no doubt the offence of murder is brutal. He, however, pleaded that there exists some mitigating circumstances like the accused after the incidence in remorse took the injured person to the hospital in his own vehicle and even offered to donate his blood and tried his best to save the life. So minimum punishment may be given to the convict, i.e., life imprisonment instead of death sentence for the offence.
