Lawyers� body critical of Centre, State Govts

GUWAHATI, Sept 8 � The All Assam Lawyers� Association (AALA) today resented the failure of both the State and Central Governments and the Gauhati High Court to comply with the Supreme Court of India�s order in connection with the infrastructural development in subordinate judiciary of the country.

In a memorandum submitted to the Chief Justice of Gauhati High Court, the AALA said that the rickety houses of the subordinate courts all over Assam depict the poor condition of infrastructural facilities of these courts in the State.

The Government in the State and at the Centre and the Gauhati High Court are equally responsible for this condition of the subordinate judiciary of the State. They have not implemented the recommendations of the Justice Shetty Commission and the Supreme Court of India order in this connection, the AALA alleged.

For the past several years the judicial officers, judicial staff and the members of the legal community engaged in the mofussil courts are suffering for want of proper infrastructural facilities in these courts.

The AALA demanded on several occasions, steps to provide proper infrastructure to the subordinate courts of the State. It pleaded for construction of residential quarters of the judicial officers, judicial staff and repairs of the old court buildings etc which are in dilapidated condition.

It has also pointed out to the fact that there are no boundary walls to provide security to the judicial officers, judicial staff and advocates in many district and subordinate courts of the State.

Moreover, in many district and subdivisions of the State there are no family courts, MACT courts, consumers courts, industrial court, Administrative Tribunal, Debts Recovery Tribunal, Foreigners� tribunal, etc. for which the litigants public of these districts concerned are suffering a lot, said the AALA in its memorandum.

At the Guwahati Principal Seat of MACT there is no special sitting arrangement, lavatory, while the Railway Magistrate�s Court is also functioning in the Railway Station from a small room without any sitting arrangement.

The posts of the Special Judge in the Special Judge�s (CBI) Court, the judges in the Fast track Court No-1 and 3 of Guwahati are also lying vacant for the past several months, said the AALA in its memorandum.
