HC upholds Nagaon court�s order to grill prime witness again

GUWAHATI, June 11 - The Gauhati High Court today upheld the decision of the Court of Sessions Judge, Nagaon, directing to re-examine a prime witness in connection with the Dokmoka lynching case. The Court of Sessions Judge, Nagaon, on June 7 had recalled witness number 17 � Numol Basumatary � for re-examination on June 12, which was subsequently challenged in the High Court.

After hearing the counsel for the State government, PP Baruah and BK Mahajan, who represented the parents of the victims, the High Court today passed an order stating that no interference was necessary at this stage as regard the order passed by the Court of Sessions Judge, Nagaon, meaning that the re-examination of Basumatary will take place tomorrow.

Prosecution had earlier reasoned that the recalling was necessary as the said witness had deposed under Sec 164 of the CrPC saying that he was an eyewitness to the occurrence and named many assailants, but later deposed otherwise.
