GUWAHATI, Nov 16 - The Gauhati High Court has stayed proceedings vis-�-vis two criminal petitions filed by BJP functionaries Rupam Goswami and Diganta Kalita challenging an FIR lodged by Congress general secretary Diganta Choudhury wherein the latter had alleged that the petitioners had broken into the premises of Rajiv Bhawan and assaulted Congressmen during a protest in 2015.
However, after duly considering the submissions made on behalf of the petitioners by advocate BK Mahajan and associates, the court on Friday stayed all further proceedings in the matter and summoned the records of the case on the ground that in two other FIRs lodged in connection with the said incident, including one by Diganta Choudhury himself, the investigating officer had already submitted final reports almost two years ago and exonerated the petitioners due to complete absence of any materials against them.
In one of the three FIRs lodged in connection with the incident (Bhangagarh Police Station case number 260/15), BJP leader Himanta Biswa Sarma was also named as an accused for allegedly mobilising BJP cadres from a distant location, although police subsequently filed a final report in the absence of any material.
The incident dates back to December 2015 when members of the BJP had demonstrated against the alleged corruption in the erstwhile Congress government, which was in power then.
