HC sets aside appointment of APC Registrar

GUWAHATI, Jan 6 - The Gauhati High Court, by acting on the writ petition [WP(C) 114/2015] filed by MC Deka, retired drugs controller, Assam, has set aside and quashed the appointment of PK Sarma, (ex-office assistant of the Assam Pharmacy Council) as the Registrar of the Assam Pharmacy Council (APC).

�In so far as public health of the State of Assam is concerned, the Registrar, APC is an important office entrusted with essential functions of monitoring the registration, renewal and activities of pharmacists in Assam. The court is of the view that the Government of Assam had not followed the procedure laid down in Sec 26(A) of the Pharmacy Act. Such illegal appointment of PK Sarma as Registrar of APC had endangered the public health in general,� the High Court said in its order.

The court also considered the related note-sheets of the appointment by the Government of Assam and observed that the Government appointed PK Sarma as Registrar without verifying his eligibility, credentials and integrity.

Welcoming the order of the court, the Pharmacist Forum of Assam said that it has authentic evidence of financial irregularities and various offences �committed by Sarma since the date when he has been associated with the APC.�

�The Government of Assam did not pay heed to several representations by different organisations towards the misdeeds of Sarma,� it added.
