HC orders development of Borduwa Than

GUWAHATI, Nov 1 � The Gauhati High Court has directed that the Chief Secretary, Assam should constitute a high-level committee of Government officials and experts, including officials representing the revenue department, cultural affairs department and the Nagaon district administration for proper and effective utilisation and development of the land at Borduwa Than, including the recently cleared area.

The committee should be constituted within six weeks from the date of receipt of a certified copy of the order and should be headed by the Chief Secretary, the order stated.

The division bench comprising Chief Justice (Acting) K Shreedhar Rao and Justice Ujjal Bhuyan in response to a PIL which was taken up suo-moto and registered as PIL No 55/2013, also asked, the Nagaon district administration to take immediate steps to ensure there is no re-encroachment in and around Borduwa Than.

After its constitution, the committee should interact with all stakeholders and experts in the field and invite suggestions /proposals regarding development of Borduwa Than as a spiritual centre, a centre of art, culture and research.

Once the project report is finalised, necessary modalities, such as, financial arrangement, execution may be worked out, the order pointed out.

The court further observed in its judgment that, �We hope and trust that, the ground work would be completed within a year from today so that actual work at the site can commence after the monsoons next year. This is a matter of public interest and while we close the proceedings with the aforesaid directions, we hope the State will ensure compliance of the aforesaid directions in letter and spirit with utmost sincerity and expedition.�

Amicus curiae SS Dey and BJ Ghosh, government advocate, Assam assisted the court during the proceedings of the case.

Senior lawyer Bhaskar Dev Konwar while hailing the judgment said that once Borduwa Than is developed as a centre of spiritual, art, culture and research, it would attract tourist, and various facets of the life and work of Srimanta Sankardev can be highlighted.
