GUWAHATI, Aug 7 The Gauhati High Court today directed the State Government to initiate necessary action against illegal allotment of land totalling over 151 bighas in Jamunamukh circle under Sankardev Nagar sub-division in Nagaon district to Markazul Ma Arif, an NGO.
The plot of land was allotted to the NGO by the then Additional Deputy Commissioner (ADC) and land premium, too, was received. The Sub-divisional Officer (SDO) concerned also executed an agreement on the allotment.
The court, in response to a PIL filed by one Idrish Ali and four other villagers of the locality, and after receipt of the inquiry report from the State Government, ordered that the ADC or the SDO were in no way authorised to make the allotment and hence the plot of land be reverted to the Gaon Panchayat . The State revenue department had submitted the inquiry report to the court on August 5.
It needs mention that although in 1995, the plot of land (village grazing reserve) was allotted to the Krishi Vigyan Kendra (KVK) for their use, the latter failed to put the land to use in three years which was fixed as the stipulated time.
As a result of non-utilisation by the KVK within the stipulated time, the plot of land was reverted to the Gaon Panchayat in 1998.
In 1999, the Sub-divisional Agricultural Officer, Hojai, executed an agreement with the Markajul Ma Arif (NGO) and accordingly the land was allotted to the NGO.
Advocate RP Sharma appeared for the petitioners.
