�Farm land cannot be sold for industrial use�

GORESWAR, Dec 19 � During the Budget Session of the Assam Assembly held at Dispur in March, 2012, a memorandum was submitted by one Mukut Sarma, secretary, North Kamrup Krishibhumi Paribesh Sangrakshan Samiti, Baihata Chariali to Jadav Chandra Deka, local MLA of Kamalpur LAC to put questions to the Revenue Minister of Assam Prithvi Majhi relating to whether agricultural land can be sold for installing industry.

According to sources, the four questions mentioned in the submitted memorandum to the local MLA were: (a) can agricultural land be sold for installation of the industry? (b) is the Government concerned about procuring of agricultural land by the outsiders of the State for installing industry in north Kamrup district area? (c) if it is acknowledged, then what step is taken for protection of the agricultural land ? (d) if it was not acknowledged (or concerned), what step would be taken by the Government for protection of the agricultural land and what suggestions would be given to the public in this regard?

Revenue and Disaster Minister Prithbi Majhi had reportedly answered Jadab Chandra Deka, local MLA, Kamalpur LAC on March 27 during the Question Hour at the Budget Session of the Assam Assembly � a) Selling of agricultural land for installing the industry has been controlled (i.e. prevented) by the Executive Instructions under the Assam Land and Revenue Regulation 1886 (amended) Part-VIII (Govt.�s Order Copy- an appendix (a) attached herewith. (b) According to received sources from the Deputy Commissioner (DC) of Kamrup district is not known that the outsiders of the State have procured the agricultural land for installation the industry in the north Kamrup district area (c) According to the DC, no permission is given in selling and procuring the agricultural land in Kamrup district (R) and d) It has been cited above in (�a�).

It may be noted that according to Executive Instruction under the Assam Land and Revenue Regulation 1886 (amended) 6.2 : Transfer of agricultural land in rural areas by cultivators for non-agricultural purposes without previous sanction of the Deputy Commissioners concerned is restricted. Para 9.1 & 9.2 of the Land Policy 1989- 6.3: Restriction on Transfer of any class of land falling within the notified areas of the Municipal and Municipal Corporation for non-agricultural purposes may not be applicable.
