Education Department withdraws earlier order

GUWAHATI, Aug 23 � The State Education (Secondary) Department has decided to allow teachers who were already re-employed (both State/national-awardee teachers) to continue as assistant teacher/subject teacher, etc., as the case may be, subject to their willingness to continue in service instead of continuing in their substantive posts held by them at the time of their retirement.

The department�s earlier order issued vide ASE 232/2008//144 dated February 5, 2010, stands totally withdrawn, an official release said.

This follows a Gauhati High Court order dated June 24, 2010, passed under WP � No. 1494/2010 (Daniram Phadangari) vs. State of Assam & others) directing the competent authority to set aside a State Government instruction issued vide No. ASE 232/2010/144 dated February 5, 2010.

The State Government had allowed for re-employment in service of State awardee teachers as assistant teacher/subject teacher as the case may be for a period of maximum one year beyond their actual date of superannuation subject to their willingness to continue in service vide an instruction issued by the Education (Secondary) Department. Subsequently, the department issued another instruction on February 5, 2010, clarifying that the benefit of re-employment shall be extended in their substantive post held by the awardee teacher at the time of their retirement instead of the post as subject teacher/teacher/assistant teacher.

Aggrieved by the Government decision, communicated vide No. ASE 232/2008//144 dated February 5, 2010, the petitioner, Daniram Phadangari, approached the High Court, and the court, in its order dated June 24, 2010, set aside the Government instruction regarding holding of substantive post.
