Devangana gets bail

NEW DELHI, Sept 1 - JNU student Devangana Kalita has been granted bail by the Delhi High Court on Tuesday. The case against Kalita pertained to her role in allegedly instigating the residents of Jaffrabad to participate in communal riots. The bail has been granted by the Single Bench of Justice Suresh Kumar Kait.

While granting bail to the JNU student, the Delhi High Court observed that the Delhi Police failed to produce any material to show that the member of Pinjra Tod, Kalita instigated women of a particular community or gave hate speech to trigger violence.

After going through the case diary along with the pen drive submitted by the police in a sealed cover, the court noted that though her presence is seen in peaceful agitation, no material was produced to show that she instigated violence or gave hate speech.

The court observed that Kalita satisfied the triple tests for grant of bail - including no chance of absconding, no probabilities of tampering evidence and coercing witnesses.
