Court stays Atul Bora�s election as AGP chief

GUWAHATI, Sept 8 - The Court of Civil Judge, Kamrup (Metro) has stayed the election of Atul Bora as president of the Asom Gana Parishad and issued summons to him, senior leaders Keshab Mahanta, Phani Bhushan Choudhury and others for violating an earlier court order.

The court held that the central executive meeting of the AGP held on August 27 where Atul Bora was elected as president of the party stands in violation of the �Injunction Order� issued on the day before (August 26).

The court was of the view that in spite of receiving the stay order of the court through WhatsApp on August 26 and having information of the stay order through media, the respondents showed complete disregard to the �stay order� and proceeded with the meeting violating the court�s order as well as the COVID-19 protocol.

The court on August 26 in response to a suit filed by Girin Talukdar, Jiten Deka and Hemen Lahkar had passed a restraining order for the AGP meeting scheduled on August 27.

�The meeting is out and out illegal as it is against the constitution of AGP as well as against the COVID protocol. The meeting violates the clause 26 of the constitution of AGP and the notification issued by the state government through State Disaster Management Department,� the order had stated.

However, the AGP went on to hold the meeting on the scheduled date and Atul Bora was elected as the party president.

Subsequently, another application was filed by senior advocate Dilip Choudhury on behalf of the plaintiff against AGP president Atul Bora, its vice president Keshab Mahanta and Phani Bhushan Choudhury among others.

The Court of Civil Judge (No. 3) after hearing the matter was of the opinion that there is a violation of court�s order and in the interest of justice the AGP should refrain from giving effect to all the resolutions passed in the meeting held on August 27 which shall also include election of Atul Bora as the president and they should also preserve the attendance register and the proceeding book of the meeting.

The court has observed that if civilization is to survive, then �Rule of Law� is to be respected and that the respect for �Rule of Law� is necessary for maintaining and strengthening the basic structure of our Constitution.
