Court for halt on construction activity beside Jorpukhuri

GUWAHATI, Oct 27 - The Court of the Additional District Judge, Kamrup Metro, has directed the Commissioner of Guwahati Police to enforce the injunction order mandating a halt on all kinds of illegal construction activity over the land and boundary wall around the historic Jorpukhuri pond of the Maa Ugratara temple.

The police, in an order issued on October 21, have also been asked to report compliance in this regard.

This came after local resident and well-known sports organizer Kalyan Das, who is also the petitioner in the case, approached the court alleging brazen display of wilful violation on the part of some members of the temple management committee, who were continuing with the demolition/construction work around the revered temple, despite being directed otherwise by the Court on February 12 last.

Of late, the Guwahati Municipal Corporation, too, has been made a party in the case.

The order dated February 12 had categorically directed both the parties to maintain the status quo and the defendants, their servants, agents, employees, workmen, etc, were directed to restrain from any demolition/construction of the boundary wall on the northern side of the Jorpukhuri pond.

The petitioner had in February also lodged an FIR with the Latasil Police Station (case number 43/2020) under Section 406 of the IPC, read with Section 4 of the Prevention of Damage to Public Property (PDPP) Act, against Parameswar Sarma (Doloi of the temple), Kailash Sarma and Indra Mohan Baruah, both members of the temple management committee, who are also the respondents in the case.

The petitioner in his petition has submitted that the defendants by misusing their status and powers broke down the outer boundary wall to suit their personal agenda, in complete violation of the laid down guidelines.

The local residents have also alleged that a �powerful group� of individuals is apparently throwing their weight behind the illegal construction.

Taking an exception to the noncompliance of the earlier order, the court, on October 21, asked the Guwahati Police Commissioner to enforce the injunction order dated February 12 through the local police station, which, in this case, is the Latasil PS.

�Photocopies of the suit land/boundary wall show that construction activity is going on in spite of temporary injunction order which shall have to be stopped to protect the subject matter of the suit. Considering the matter in its entirety, police help is necessary to preserve the subject matter of the suit,� the order stated.

The court had earlier stated that the Maa Ugratara temple is a historic site and its preservation is necessary and therefore, if the defendants are not restrained from constructing the boundary wall then it would amount to an irreparable loss to society.
