Complainant in land grabbing case under pressure

GOALPARA, June 26 - The recent unearthing of a case of grabbing of land measuring 2 kathas in the revenue village Cha Bagan pertaining to patta no 32 covered by Dag no 946 (new)/ 376 (old) in the Geetanagar area of the town and the ongoing probe in this regard, is gradually bringing to the fore, a nexus between some well-connected people with some revenue officials, who are allegedly putting tremendous pressure on the investigating agency as well as on the complainant Upendra Narayan Roy, r/o of Abhyapuri, Bongaigaon district to withdraw the case.

However, in an interesting official faux pas, with regard to a petition dated 22nd June, 2016 addressed to the Deputy Commissioner /Deputy Collector, Goalpara filed by the complainant Upendra Narayan Roy with a prayer to take legal action against the offenders (Nanda Barman Choudhury, w/o Mahesh Choudhury of Geetanagar, Mahesh Choudhury, s/o Late Girish Choudhury of Geetanagar, Abu Lias Choudhury then ASO, Balijana Revenue Circle now posted at Dhubri Revenue Circle, Bishnu Kalita s/o Late Mohendra Kalita, then kanoongu of Balijana Revenue Circle, Lat no. 5, presently kanoongu of Lakhipur Revenue Circle, r/o Bapujinagar, Kailashpati Rajbonshi, then Lat Mandal of Balijana Revenue Circle Lat no. 5, now Lat Mandal of Matia Revenue Circle, Lat no. 7, r/o village Salpara, Molandubi Subhendu Sharma, s/o Ajay Kr Sharma, r/o Jyotinagar and Rajkumar Rabha, s/o Late Bhabani Shankar Rabha), as per the provisions of Section 340 of the Code of Criminal Procedure, 1973 for mutating a property by submitting false declaration and evidence and further to draw up departmental proceedings against the revenue officials, whose names have been mentioned herein for abusing their official capacity, a letter no. GRK. 11/2016/54 dated June 24th, 2016 was promptly issued by the District Development Commissioner( also the incharge of the Revenue Department) Faroque Alom to the complainant by completely altering the subject title to �appeal petition for cancellation of mutation � regarding...�.

The complainant was further requested to file an appeal as per the provisions of Section 151 of the Assam Land Revenue Regulation Act , 1886 for cancellation of the said mutation besides a condonation petition before the District Registrar, Goalpara. This ingenious action on the part of a senior administrative official bespeaks of the intentions of giving a cover to the entire episode instead of announcing an official investigation by the district administration on the entire issue of land grabbing and tampering of land records on the basis of forged documents under the Balijana Revenue Circle. The conscious citizens of Goalpara have demanded an inquiry from the Chief Minister�s Vigilance/Anti-corruption cell into this land grabbing episode and also on all land sale and purchase to have taken place during the last three years.

Meanwhile, one of the revenue officials Bishnu Kalita, whose bail application was rejected earlier and who is under medical custody since the date of arrest (June 19) has not been discharged by the attending doctor Seema Hazarika, even though the accused is normal and faking illness, reliable sources from the civil hospital said. Another accused Kailashpati Rajbonshi against whom no official action has been taken is still absconding and evading arrest and is absenting from official duties.

Meanwhile, this correspondent could lay his hands on some official documents which amply authenticates the claims of the complainant, Upendra Narayan Ray, who has registered a case no. 311/16 at the Goalpara Sadar PS and charges under Section 420 /468/470/34 of the IPC read with Section 5 of the Assam Land Grabbing Act have been framed against these accused. However, the then ASO of the Balijana Circle, Abu Lais Choudhury has filed for anticipatory bail, a reliable source said.

Moreover, Upendra Narayan Ray, when contacted over phone said that he will fight till the end to get justice.
