MUMBAI, Dec 15 (Agencies): The Bombay High Court has slammed BCCI, saying its decision to terminate Kings XI Punjab�s contract was wrong.
According to the High Court, the BCCI�s notice to Kings XI was not right as the control of the team stayed with the partners. The court refused to agree with BCCI�s defence on the argument that Kings XI�s ownership pattern changed, without their approval, which is a breach of terms of agreement.
KXIP owner Priety Zinta was ecstatic: �Our stand has been vindicated, we are very very happy. Thank you to our lawyers and fans.�
The single person bench of Justice SJ Vazifdar had remarked that going by the documents, Kings XI had �made out a strong case�.
As a result, the dispute will go before a new arbitrator. The previous arbitrator, Justice BN Srikrishna, had recused himself. As things stand, the Kings XI will take definite part in the players� auction in January.
The franchisee has been directed to produce bank guarantees for making up the losses that BCCI, as well as the its own players, might suffer in case the arbitrator�s award goes against Kings XI.
Kings XI have also been asked to clear the dues of players for the previous season. �It is a question of national prestige,� he said.
The court also recorded a statement made by Kings XI�s lawyer Darius Khambata that present share-holding pattern of owners � which includes actor Preity Zinta and industrialist Ness Wadia � will not change, and shares will not be sold without Court�s or arbitrator�s permission.
