NEW DELHI, May 5 - The clearance of the Assam Molasses Control Bill, 2011, is likely to be delayed as the Assam Government has been advised to amend provisions of the legislation.

Replying to a Rajya Sabha question by Santiuse Kujur, Minister of State in the Ministry of Home Affairs Haribhai Parathibhai Chaudhary said that whenever necessary, the State Government has been advised to amend provisions of the legislation.

While examining the Bill from a legal angle, the Centre drew the attention of the State Government to certain court proceedings having a bearing on the matter and suggested seeking of the opinion of the Advocate General of the State. The State legislations are examined in consultation with the Central ministries concerned from three angles � repugnancy with Central laws, deviation from national or Central policy, and legal and constitutional validity, he said.

Sometimes, discussions are also held with the State Government and departments of the Government of India with a view to arrive at a final decision. As the Ministry has to depend on the clarifications of various ministries and the State Government on the provisions of the Bill, it is difficult to fix a time-frame for its approval, said Chaudhury.

As passed by the Assam Legislative Assembly and reserved by the Governor under Article 200, read with Article 254(2) of the Constitution of India, for consideration of the President of India under Article 201 of the Constitution of India, the Bill was received by the Ministry, confirmed the minister.

According to procedure, the Bill was examined in consultation with the Central ministries concerned.
