Ex-MLA gets interim anticipatory bail

GUWAHATI, March 15 - Two-time former legislator and Bharatiya�Janata Party�s candidate for the ensuing Assembly polls Pranab Kalita was today granted interim anticipatory bail by the Gauhati High Court on Monday in connection with a case relating to defalcation of public fund during 2005-06.�

Advocates Bijon Kumar Mahajan and Arshad Choudhury who appeared for the accused contended before the Court of Justice Indira Shah that the entire case related to political vendetta, which was why the complaint was lodged almost a decade later (2015) presumably to gain political mileage.

The court, after hearing the defence counsels along with public prosecutor Nava Dutta, allowed the accused to go on interim anticipatory bail.

The case which was registered last year under Section 409 of the IPC read with Sec 7 of the Prevention of Corruption Act, relates to alleged defalcation of MLA fund meant for digging of ring wells, construction of road and a library in Palasbari constituency. The case was lodged by Pankaj Chakrabarty, Circle Officer, Palasbari revenue circle.
