Provide info about Daimary�s family: HC

GUWAHATI, May 4 � The Division Bench of Gauhati High Court comprising Justice Ranjan Gogoi and Justice BP Katakey after hearing a writ petition (criminal) No. 9/10 filed by Anjali Prova Daimary directed the Central Government and the State Government yesterday to take instruction on whereabouts of Lina Daimary, wife of Ranjan Daimary, Udangsa Daimary, son of Ranjan Daimary and Udangsree Daimary, daughter of Ranjan Daimary and fixed the case for further hearing on May 5.

The habeas corpus petition was filed by Anjali Daimary before the Gauhati High Court alleging that Ranjan Daimary, chairman of NDFB was arrested along with his wife and children by Bangladesh Rifles and handed over to BSF on May 1 at Dawki, Meghalaya. Although Ranjan Daimary was produced before the CJM, Kamrup on May 2 and remanded to police custody for 12 days, but the whereabouts of the wife and children of Ranjan Daimary are not known to the petitioner and the family members.

Further, the police authorities have not allowed Anjali Daimary and other family members to meet Ranjan Daimary and as such, they could not provide legal assistance to him. In the petition, it was also alleged that the action of the State authorities amounts to violation of principles laid down by the Supreme Court in the case of DK Basu vs State of West Bengal.

The court after hearing the case issued notice upon the Central Government and the State of Assam and directed to provide information as regards whereabouts of the wife and children of Ranjan Daimary and also allowed Anjali Daimary to meet her brother Ranjan Daimary as per convenience of the police authorities.

Manas Sarani and Sabda Rabha, advocates appeared for the petitioner while C Barua, advocate represented the Central Government and PS Deka, Govt. advocate represented the State of Assam before the court.
