Niranjan Hojai�s bail plea rejected

GUWAHATI, July 21 � The Court of Special Judge, NIA today rejected the bail petitions of DHD(J) �commander-in-chief� Niranjan Hojai and the outfit�s chairperson Jewel Garlosa in connection with NIA case (No. 1/2009).

Our Staff Reporter adds: The judgment assumes significance because the Central as well as the State governments have submitted their no-objection certificate to the Court a couple of days back facilitating the duo�s possible release on bail.

The National Investigation Agency (NIA), which is investigating the case, found that terrorists belonging to DHD(J) conspired to divert huge amounts of developmental funds allocated to the North Cachar Autonomous Hills Council for procurement of arms and other terror activities.

The bail petitions were rejected on the strength of Sec 43(D) of the Unlawful Activities (Prevention) Act, which includes a provision as per which the bail petition of any accused can be rejected if prima facie case has been found.

Moreover, in connection to NIA case 2/2009, the Court has fixed July 25 as the date for judgment as some records pertaining to the case are in the possession of the Gauhati High Court.

The NIA had already filed chargesheets in connection with both the cases.

Advocate Bijon Mahajan and Arshad Choudhury represented the accused in the Court.
