HC rejects Subba bail plea in rape case

GUWAHATI, July 29 � The Gauhati High Court by an order yesterday rejected the prayer of anticipatory bail of Mani Kumar Subba, former MP, in connection with a Chandmari PS case (No. 253/10) registered under Section 376 of IPC.

An FIR was lodged against Subba by a lady alleging inter alia that she was raped by Subba on July 13 at his residence and a case was registered at Chandmari PS in this connection.

Subba filed an application under Section 438 CrPC before the Gauhati High Court praying for granting anticipatory bail in connection with the said case. The court on July 21 while granting interim bail to Subba directed the public prosecutor to produce the case diary along with medical examination report, etc. The statement of the victim lady was also recorded under Section 164 CrPC as well as the statement recorded by the investigation officer under Section 161 CrPC.

Justice HN Sarma yesterday after hearing the bail petition and also after examination of the case diary, forensic report and medical examination report of the victim lady, rejected the prayer of anticipatory bail of Subba.

JM Choudhury, Sr Advocate, appeared on behalf of Subba while K Monir, public prosecutor, appeared on behalf of the Govt of Assam before the court.
