GUWAHATI, July 27 � The Gauhati High Court by a judgment dated July 19 has direct the Director General of Police, Assam to constitute a Special Investigation Team (SIT) with senior officers, empowered to consolidate all identical cases of fraud upon public at large by way of floating fictitious/ bogus companies or by way of operating money circulation scheme, without obtaining proper license/ permission from appropriate authorities and to investigate the same simultaneously.
Justice BD Agarwal after hearing a criminal case (Crl Pet No. 98/2010) filed by Accresent Way Marketing Pvt Ltd & others challenging the Paltan Bazar PS Case No. 78/10 which was registered on the basis of FIR filed against the Company under Sections 420/406 IPC and during the course of investigation Section 4/5/6 of Prize Chits and Money Circulation Scheme (Banning) Act, 1978 had also added with due permission from the CJM, Kamrup.
The court after hearing the case passed the judgement on July 19 dismissing the prayer of the petitioner and further observed that very recently, scores of identical cases have been registered in many police stations in Assam against various firms and companies, having found prima-facie cases of fraud upon public at large. The court accordingly directed the Director General of Police, Assam to constitute a Special Investigation Team to investigate all identical cases.
The court further observed that such an approach would not only expedite the investigation of large number of cases, it will also bring the cases to the logical conclusion with sound reasoning, in view of manifold evidence, which may come in different cases.
