The petitioners are job card holders and they are aggrieved by non-allotment of 100 days guaranteed works, under the MGNREGR scheme.

Dr Konwar, counsel for the petitioners submitted that under section 3 of the Mahatma Gandhi National Rural Employment Guarantee Act, 2005, 100 days work is guaranteed for all job card holders. But despite stufficient funds being provided for the concerned block, the job card holders were being denied the guaranteed work. Therefore, it is alleged that the earmarked amount is being misappropriated by the implementing authorities under the Panchayat and Rural Development Department, the Court observed.
