HC notice to Govt, colleges on provincialisation

GUWAHATI, Sept 28 � The Gauhati High Court has issued notice to the State government, the Education Department and the presidents of the governing bodies of BN College, Dhubri, JDSG College, Bokakhat, and Sonari College, Sivasagar, asking them to clarify their stand whether they were strictly complying with the provisions of the Assam College Employees Provincialization (Amendment) Act, 2012.

This follows a writ petition (C) No.4,899 by a few aggrieved persons before the court.

It is worth mentioning that as per amended provisions of the Act, all principals of provincialized colleges of Assam shall form an independent cadre and the selection and appointment for the post of Principal in all the provincialized colleges are to be made centrally, and to that effect there is a notification from the Director of Higher Education, Assam.

The case is again fixed for November 26, 2014, and in the mean time, the court has directed that any appointment made in the post of Principal of provincialized colleges of BN College, JDSG College and Sonari College shall be subject to the outcome of the writ petition.

Advocate Bhaskar Baruah appeared for the petitioners while the State government was represented by M Choudhury, Standing Counsel (Higher Education).
