GUWAHATI, May 26 � The Gauhati High Court, after hearing a writ petition (Civil) No. 2502/12 filed by the North Eastern Plastic Manufacturing Association challenging the order dated May 10, 2012 issued by the Commissioner, Guwahati Municipal Corporation whereby sale and use of plastic cups and plates etc. has been banned within the Guwahati Municipal area from June 1, 2012, issued notice upon the respondent authorities.
The writ petition has been filed challenging the order of Commissioner, GMC banning use of plastic cups and plates on the ground that it is the State Pollution Control Board which is the competent authority for enforcement of Plastic Rules for manufacture of plastic items and under Sub-Rule (b) of Rule 4 of the Plastic Waste (Management and Handling) Rules, 2011, the municipal authorities are entrusted with the responsibility of disposal of plastic waste. Rule 5 also makes the municipal authority responsible for setting up efficient collection system for plastic waste and the responsibility of the users are also indicated for proper disposal of waste plastic.
Justice Hrishikesh Roy after hearing the writ petition issued notice returnable on May 30, 2012 and further observed that notice on the interim prayer is also made returnable on the same date.
