Court orders Akhils medical check-up

By STAFF REPORTER

GUWAHATI, March 29 The production warrant issued by the Judicial Magistrate of Titabor against KMSS leader Akhil Gogoi has been endorsed by the Additional Chief Judicial Magistrate, Guwahati, while making an observation that the accused be medically checked by a doctor/ expert prior to his departure for Titabor.

A team of Jorhat Police is currently camping in Guwahati to take Gogoi into custody in connection with a case registered under Section 353 of the IPC, besides a couple of other bailable sections.

The Code of Criminal Procedure under Sec 269 empowers the jail authority not to send an accused outside jail wherein he is lodged, if he is medically unfit.

The Court of Additional Sessions Judge, Kamrup (Guwahati) also passed an order that Akhil Gogoi be taken to the Guwahati Medical College and Hospital on April 1, 2014 as the earlier medical examination on him was inconclusive.

Advocates Bijon Mahajan and Shantanu Barthakur appeared on behalf of the accused in the Court of Additional CJM, Kamrup (Guwahati) and the Court of Additional Sessions Judge.

Meanwhile, the bail bonds of Akhil Gogoi in all eleven cases have been accepted by the magistrate concerned and reached Guwahati Central Jail after dark.

With the jail authority placing a notice outside the jail stating that bail bonds received after dark would not be accepted during the course of the night, Akhils immediate release hangs in the balance.

It has been learnt that a team of experts/doctors has been requisitioned by the jail authority to examine Gogoi in jail.

Meanwhile, the State BJP unit today alleged that Chief Minister Tarun Gogoi has conspired to keep Akhil behind bars for his political benefits.
