GUWAHATI, Feb 10 � After Government of India and the main Opposition at Centre in Bharatiya Janata Party, the Assam Government has also expressed its disapproval of the Supreme Court�s recent ruling giving immunity to persons associated with banned organisations unless their acts incite imminent unlawful action.
Chief Minister Tarun Gogoi told media persons today that the ruling could have serious consequences in the State, including the rest of the country and could encourage people joining banned outfits and take the wrong path.
�I am going to write to the Government of India seeking review of the apex court�s recent ruling, which I feel would also boost anti-national forces, besides creating law and order problem,� Gogoi stated.
The apex court, on Friday, had said that being a mere member of a banned group will not make a person a criminal unless he resorts to violence or incites people to violence or creates public disorder by violence or incitement to violence.
The ruling was part of a judgment that acquitted Arup Bhuyan, who was convicted by a designated court in Guwahati under the anti-terror law Terrorist and Disruptive Activities (Prevention) Act, or TADA, which is now lapsed.
Bhuyan was a suspected member of the outlawed ULFA.
