Arrested SPOs get bail

By Staff Reporter

GUWAHATI, Aug 5 - In a relief to the agitating Special Police Officers (SPOs), the Gauhati High Court on Tuesday termed their rearrest, soon after being released on bail in connection with a pending criminal case, without apprising and disclosing the Court about pendency of the said case, as illegal. The Court passed the order citing precedence of a Supreme Court ruling way back in 1983.

The Court, while observing this, granted bail to Dilip Saikia and Mrityunjoy Borah, the two SPOs who were arrested on three occasions in connection with the case related to exchange of fire with police personnel during a protest programme in June this year.

The SPOs, who were represented by advocates Bijon Mahajan and Arshad Choudhury, were also granted anticipatory bail in another case registered against them under Harangojao Police Station under Sections 121/121(A)/122/109 IPC read with Section 27 of the Arms Act.
